Please read these terms and conditions carefully. To use this website you must accept the following terms and conditions (as amended from time to time).If you do not wish to be bound by these terms and conditions you will be unable to use this website.

  1. To use this website you must agree to the general conditions for using the Department’s Online Services website. You must also agree to the particular conditions for using the Visa Entitlements Verification Online (VEVO) website.
  2. The Privacy Act 1988 has specific provisions that prohibit any officer of the Commonwealth of Australia from collecting, using or disclosing anyone’s personal information except in performing their duties and in specific situations permitted by law.

The Commonwealth Department of Home Affairs provides the Entitlements Verification Online website (the Website), and all materials, information, software, services and consequential changes included in or available through the Website (the Services), on an ‘as is’ and ‘as available’ basis for your use. The Commonwealth of Australia makes no statements, representations or warranties that the contents of the Website and information accessed through the Website are accurate, complete, reliable, correct or free from error or omissions and makes no representations about its suitability for any particular purpose. You should make your own judgements about those matters and/or seek independent advice. You must only use this facility to make inquiries about your own immigration status and visa details.

The Commonwealth of Australia does not warrant that the Website will be available at any particular time or location, that the Website service, and access to it, will be uninterrupted, that any defects or errors will be corrected or that the Website and its content are free from viruses or other harmful components.

Home Affairs will make every effort to ensure that the information provided through the Website is accurate.

Information or materials that are offensive, pornographic, unsuitable for minors’ access or otherwise of a criminal or violent nature may be accessible through the Website, either as a result of hacking or material placed on linked web sites. The Commonwealth of Australia makes no representations or warranties as to the suitability of the information accessible for viewing through the Website.

You assume all risks associated with the use of the Website, including (without limitation):

  • The risk of your computer, software or data being stolen, or damaged as a result of a virus or other online threat which might be transmitted or activated via the Website or your access to it;
  • The risk that the content of the Website and linked websites complies with the laws of any country outside Australia.

No Liability

Under no circumstances will the Commonwealth of Australia or its employees be liable for any direct, indirect, punitive, incidental, special or consequential damages related to your violation of these terms and conditions, or that result in any way from your use of or inability to use the Website or your reliance on or use of the Services accessible through the Website, or that result from mistakes, omissions, interruptions, deletion of files, errors, defects, delays in operation, or transmission, or any failure of performance.

To the extent permitted by law, the Commonwealth of Australia excludes all responsibility for loss or damage arising from the use of, or reliance on, the information contained on or accessed through the Website, including (without limitation) loss of profit and loss of data, whether or not caused by any negligence on the part of the Commonwealth of Australia or its employees.

You agree to indemnify the Commonwealth of Australia from and against any loss, cost or expense incurred arising from any claim, suit, demand, action or proceeding by any person against the Commonwealth of Australia arising from your use of the Website.

User Access

Your access and use of the Website, or portions thereof, may be restricted through the use of a login registration mechanism or similar process (collectively User Account). You are responsible for maintaining appropriate confidentiality of your User Account, and are fully responsible for all activities that occur under it.

You should only use this facility to make inquiries about your own immigration status and visa details.

You agree to:

  1. immediately notify Home Affairs of any unauthorised use of your User Account or any other breach of security, and
  2. ensure that you close your web browser at the end of each session. Failure to do this may result in personal information provided through this website being disclosed to third parties in contravention of the Privacy Act. The Commonwealth of Australia will not be liable for any loss or damage arising from a failure to comply with this provision.

Home Affairs may change, suspend or discontinue any aspect of the Services at any time, including the availability of any feature, database, or content available at the Website. Home Affairs may also impose limits on certain features and services or restrict your access to parts or the entire Website without notice or liability.

Formation of Agreement and Severability

A legally binding agreement (the Agreement) is formed only when you indicate your acceptance of these Terms and Conditions.

Unless otherwise specified herein, the terms of this Agreement constitute the entire agreement between you and Home Affairs with respect to the Website and supersede all prior or contemporaneous communications and proposals (whether oral, written, or electronic).

If any part of these Terms and Conditions is held invalid or unenforceable the remaining portions remain in full force and effect.

The section titles are for convenience only and have no legal or contractual effect.

Termination

Home Affairs reserves the right, in its sole discretion, to terminate your access to the Website, or an area of the Website immediately and without notice. If you do not agree with these Terms and Conditions your sole and exclusive remedy is to cease using the Website.

Where Home Affairs has terminated your access to the Website, the User Account you have been issued will cease to be valid and you will be unable to access the Website.

The Commonwealth of Australia will not be liable to pay compensation for termination of this Agreement and the User will not be entitled to compensation for any losses incurred as a result of the termination.

Survival

In the event that access is terminated as provided herein or the User ceases using the Website these Terms and Conditions will survive.

Changes to these Terms and Conditions

Home Affairs may change these Terms and Conditions at any time, by publication of an updated form of these Terms and Conditions on the Website. The date appearing next to the words ‘current as at’ will indicate when these Terms and Conditions were last updated. Users should review the Terms and Conditions published on the Website from time to time.

Privacy

Your personal information is protected by law, including the Privacy Act 1988.

You acknowledge that:

  1. Important information about the collection, use and disclosure (to other agencies and third parties, including overseas entities) of your personal information, including sensitive information, is contained in the department's Privacy Notice.
  2. You have read the information contained in the Privacy Notice.
  3. You understand that the department may collect, use and disclose your personal information (including biometric information and other sensitive information) as outlined in the Privacy Notice.
  4. The Commonwealth is not responsible for the content and privacy practices of other websites linked to the VEVO Website and encourages you to read each site’s privacy policies.

Security of information

Your personal information will not be disclosed unless the law permits it or your permission is given.

Home Affairs operates the Website with outsourced technical assistance.

This information may be used in the event of an investigation into apparent improper use of Home Affairs Internet facility, or where a law enforcement agency exercises a warrant to inspect the Internet Service Provider’s logs.

If your inquiry indicates that you are not entitled to be in Australia, Home Affairs may use this information to take appropriate administrative action.
